Syarat Pengajuan Hibah Tanah
1. Menurut Undang-Undang
Secara hukum, ketentuan hibah tertuang dalam Peraturan Pemerintah (PP) No.24/1997.
Di dalam PP tersebut, dapat diketahui bahwa proses hibah dan pembuatan suratnya harus dilakukan oleh PPAT/notaris.
Bahkan, merujuk Pasal 19967 KUHPerdata, ada pula beberapa syarat lain yang harus dipenuhi agar hibah tanah dianggap sah:
- Objek yang dihibahkan harus memiliki manfaat bagi penerimanya
- Objek yang dihibahkan harus memiliki bentuk dan tidak dalam proses perencanaan
- Objek yang dihibahkan tidak terikat perjanjian, seperti gadai dan harta gono-gini
- Pemberi dan penerima hibah harus berusia dewasa sesuai ketentuan undang-undang
- Akta notaris asli akan disimpan oleh notaris yang sudah ditunjuk oleh para pihak
- Proses ini harus disertai surat persetujuan anak kandung/ahli waris pemberi hibah.
Selain syarat umum, ada pula sejumlah dokumen yang harus dikumpulkan saat mengesahkan proses hibah di kantor desa/kelurahan setempat, seperti:
- Surat pengantar dari RT/RW
- Fotokopi KTP pemberi hibah dan penerima hibah
- Fotokopi KK pemberi hibah dan penerima hibah
- Fotokopi SPPT PBB-P2
- Fotokopi Letter C
- Informasi ukuran tanah yang telah disepakati
- Materai Rp10.000 sebanyak empat lembar.
2. Menurut Syariat Islam
Bagi umat muslim, penting memerhatikan syariat Islam sebelum melakukan hibah.
Selain di mata hukum, hal ini dimaksudkan agar proses hibah dianggap sah secara agama.
Islam sendiri memperbolehkan proses hibah, asal memenuhi sejumlah syarat berikut:
- Pemberi dan penerima hibah sudah berusia dewasa
- Hibah tidak boleh dilakukan kepada orang yang belum lahir
- Sehat akal, waras, dan sadar akan tindakan yang dia lakukan
- Perkawinan tidak menjadi penghalang seseorang menghibahkan barang
- Jika ingin memberi hibah kepada orang yang belum dewasa, proses hibah harus dilakukan (secara langsung tanpa perantara) di hadapan orang tua yang bersangkutan
- Memberi hibah kepada orang yang tidak sehat akal dan pikirannya juga diperbolehkan, tetapi prosesnya harus dilakukan oleh wali yang bersangkutan.
Cara Membuat Surat Hibah Tanah
Setelah semua persyaratan terpenuhi, kamu sudah dinyatakan siap untuk melakukan hibah tanah di hadapan PPAT/notaris.
Ajaklah penerima hibah dan dua orang saksi mendatangi lokasi PPAT/notaris yang ditunjuk.
Jangan lupa membawa dokumen persyaratan hibah, lalu sampaikan maksud dan tujuanmu kepada PPAT/notaris tersebut.
Akad hibah akan disaksikan secara langsung oleh PPAT/notaris dan para saksi.
Jika sudah, PPAT/notaris akan membuatkan surat hibah tanah sesuai kebutuhan.
Lalu, dia akan memintamu dan para saksi untuk menandatangani surat tersebut.
Nantinya, PPAT akan menyerahkan dokumen persyaratan beserta surat hibah tanah ke kantor kelurahan/desa setempat.
Jika semua dokumen dinyatakan valid, maka surat hibah tersebut akan ditandatangani kepala desa/camat dan disahkan dengan cap.
